So a Wyoming family builds through gestational surrogacy the way the law leaves it: a written agreement drafted before any medical step, independent counsel for each side, and a parentage order your attorneys plan for your match and ask the district court to enter. The same Act says a child born to parents who are not married to each other has the same rights under the law as a child born to parents who are married to each other.
Wyoming's vital-records law then adds a second route, for the families who fit it. It describes one specific kind of gestational agreement, written and notarized, between two intended parents who have lived in Wyoming for at least the year before signing and a gestational carrier, filed and sealed with the state registrar, with compensation limited to expenses connected to the pregnancy, including lost opportunity. An agreement that meets every one of those conditions gets an administrative birth-certificate route: once the state office of vital records verifies the agreement, the intended parents are treated as the child's parents for the birth certificate, with no court order needed. Those conditions belong to that one route, and the act that created it says it is not intended to alter the rights and legal status of any person it does not specifically address. For every other match the same law names the court route: for birth registration the woman who gives birth is treated as the mother unless a court orders otherwise, at any time, and the court's order directs the state office of vital records to issue an amended birth certificate. A parentage proceeding can be started before the birth but is not concluded until after it, which is why the timing of the order is your attorneys' plan for your match, never a promise a page can make. A note on accuracy. We work in gestational surrogacy only, where the surrogate is not genetically related to the child.
